5.2 Payment Methods Accepted: 5.2.1 Accepted Payment Options: (a). We accept multiple payment methods to facilitate transactions. These include bank transfers, credit/debit cards, and various online payment platforms. (b). Clients must ensure that they comply with any specific requirements associated with their chosen payment method, such as providing necessary billing information or covering any applicable credit card processing fees. 5.2.2 Currency Specifications: (a). All payments must be made in the specified currency, which will be indicated in the service agreement (e.g., USD, INR). (b). For international clients, any currency conversion fees incurred during the payment process will be the responsibility of the client, and we recommend confirming conversion rates with your bank or payment provider.
5.3 Billing Cycle and Invoicing: 5.3.1 Billing Cycle: (a). The billing frequency will be defined in the service agreement and may be structured as monthly, quarterly, or upon project completion. (b). Each billing cycle will have specified start and end dates, allowing for clear financial planning and budgeting for your startup or company. 5.3.2 Invoice Issuance: (a). Invoices will be generated and sent to clients at the instant for instant billing services, end of each billing for billing cycles or upon project completion, as agreed. (b). Invoices will be provided in a digital PDF format, ensuring easy access and record-keeping for your business. Physical copies can be requested but may incur additional shipping fees. 5.3.3 Invoice Content: (a). Each invoice will include an itemized list of services rendered, the total amount due, payment terms, and any applicable taxes or additional fees. (b). Clients are encouraged to review invoices promptly. If there are any disputes regarding charges or if adjustments are needed, clients should contact us within 24 hours of invoice receipt to resolve any issues.
5.4 Late Payments and Penalties: 5.4.1 Grace Period: (a). We offer a grace period of 7 days after the due date for late payments, allowing clients a brief window to settle outstanding balances without penalty. (b). It is advisable to make payments within this period to maintain good standing and avoid additional fees. 5.4.2 Late Payment Fees (a). Should payment not be received within the grace period, late payment fees will be applied. This may be a fixed fee or a percentage of the overdue amount, as specified in the service agreement. (b). Late payment fees will be calculated and added to the outstanding balance, and clients will be notified of these changes. 5.4.3 Suspension of Services: (a). Continued late payments may result in the suspension of services and access to ongoing projects. This includes halting work until the outstanding balance is settled. (b). Prior to service suspension, we will attempt to contact clients to resolve any payment issues, ensuring that you are informed and have the opportunity to rectify the situation.
 
6. Termination of Services

 

This section outlines the conditions under which services may be terminated by either party, the consequences of termination, and the rights that will apply upon termination. Given the nature of our digital and service-based offerings, AnalyticXperts aims to maintain a clear and professional relationship with all clients.

 
6.1 Conditions for Termination by Either Party: (a). Termination by Client: The client may terminate services at any time by providing written notice to AnalyticXperts, subject to the following conditions: Clients must provide written notice prior to the intended termination date  at least 7 days before, Clients are responsible for settling any outstanding invoices for services rendered up to the termination date. (b). Termination by AnalyticXperts: AnalyticXperts reserves the right to terminate services under the following circumstances: If the client breaches any terms outlined in this agreement, including failure to make timely payments or providing false information during account registration, If the client engages in any activities that are illegal, harmful, or disruptive to our services or the services of other clients or Society, If circumstances arise that prevent AnalyticXperts from fulfilling its obligations, such as force majeure events.
6.2 Consequences of Termination: (a). Upon termination of services, all access to the online services provided by AnalyticXperts will be suspended immediately.

(b). Clients will receive a final invoice reflecting any outstanding amounts due for services rendered prior to termination, which must be settled within 30 days of receipt. (c). All proprietary materials, documentation, and deliverables provided by AnalyticXperts will remain the property of AnalyticXperts until full payment is received. (d). Clients must cease all use of AnalyticXperts’ services and platforms immediately upon termination.

6.3 Rights Upon Termination: (a). Clients will retain the rights to any data or content they have created using AnalyticXperts’ services, provided that they have fulfilled all payment obligations. (b). AnalyticXperts retains the right to withhold any deliverables or outputs until all outstanding payments have been settled.

(c). Both parties agree to maintain the confidentiality of any proprietary or sensitive information shared during the course of the engagement, even after termination.  (d). Termination of services will not affect any accrued rights or liabilities of either party as of the termination date.

Should an amicable resolution not be reached, the parties will engage in mediation. (b). Mediation will be conducted under the rules of a reputable Indian mediation body or a mutually agreed-upon alternative, and shall take place in Visakhapatnam, Andhra Pradesh. (c). Arbitration: If mediation fails, any unresolved disputes will be submitted to binding arbitration. The arbitration will be conducted by a single arbitrator in accordance with the rules of a recognized arbitration institution in India. (d). The arbitrator’s decision shall be final and binding, and judgment may be entered upon it in any court of competent jurisdiction. Each party shall bear its own costs and expenses related to the arbitration unless otherwise decided by the arbitrator.
7.3 Jurisdiction and Venue: (a). You agree that any disputes arising from the use of our services or related to these Terms shall be resolved in the appropriate state or district court located in Visakhapatnam, Andhra Pradesh. (b). You waive any objection to the venue of any such proceeding and any claim that such proceeding has been brought in an inconvenient forum.
